AGREEMENT TO TERMS

1. Overview

Welcome to ArtMules! These Terms of Service (“Terms”) govern your access to and use of products and services offered by L’Oreal Frye, operating under the name ArtMules (“we,” “our,” “us”). By purchasing our digital products, commissions, or engaging with our services, you agree to comply with and be bound by these Terms.

2. Services Offered

ArtMules specializes in:

  • Hand-drawn custom digital art (including overlays, emotes, and stream branding assets)

  • Artwork for fine art prints and merchandise

  • Digital commissions (including custom emotes, channel graphics, etc.)

All services are delivered digitally via email, cloud storage, or download link unless otherwise stated.

3. Custom Art & Commission Agreements

By placing a custom order, the following terms apply:

  • Scope of Work: You will receive original, hand-drawn digital artwork as specified in your order (e.g., emotes, overlay packages). You will be informed of timelines prior to delivery.

  • Turnaround Time: 2–10 business days depending on the order size and complexity.

  • Revisions: One minor revision is included per item. Major revisions requiring a redraw will incur a fee (e.g., $15 per emote).

  • Approval: Once the first concept is delivered, you may request changes. Payment is required in full before final files are released.

4. Payment Terms

  • A non-refundable deposit of 25% (minimum $15) is required to begin work.

  • Full payment is due before final files are transferred.

  • We accept payments via [PayPal, Apple Pay, & Zelle].

5. Refund & Cancellation Policy

  • Full refund (minus processing fees) available only if cancellation occurs before work begins.

  • If work has begun, the 25% deposit is non-refundable.

  • No refunds once final deliverables have been sent.

6. Ownership & Usage Rights

  • Upon full payment, you receive exclusive rights to use the artwork for personal use only.

  • Commercial use (including monetization, merchandise, etc.) requires a separate agreement.

  • You may not redistribute, resell, modify, or claim ownership of the artwork.

  • Emotes, overlays, and similar works are custom-created and will not be reused or resold by ArtMules.

7. Prohibited Use

Clients may not:

  • Alter or edit the artwork without permission

  • Use the artwork for unlawful, hateful, discriminatory, or misleading purposes

  • Train AI models or submit artwork to AI platforms or NFT services without explicit, written consent

8. Intellectual Property

Any sketches, drafts, or rejected concepts remain the intellectual property of ArtMules (L’Oreal Frye). Only the final, delivered product is transferred to the client under the specified license terms.

9. Technical Limitations & Liability

While we strive to provide high-quality digital products, we are not liable for:

  • Compatibility issues with your software or platform

  • Platform policy changes (e.g., Twitch, YouTube) affecting the use of the asset

  • Data loss after final files are delivered (please back up your files)

10. Age Restrictions

You must be 18 years or older to commission work or purchase from ArtMules.

11. Privacy

By placing an order, you consent to the collection of limited personal information (name, email address, payment info) solely for the purpose of order fulfillment. We do not sell or share your data with third parties.

12. Jurisdiction & Dispute Resolution

These Terms are governed by the laws of the State of Texas. All disputes shall be resolved through arbitration in Dallas County, Texas. You waive the right to file a lawsuit in public court.

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.
